Oh Yeah, there is also the property at: 521 Florida Ave NW, Bend, OR 97701 that Bernath seems to have forgotten about, and he seems to have forgotten the police reports at the address.

For those kind readers of this forum who may wish to assist the garbage collectors of Ft. Meyers with garbage collection and removal from the Bernath residence (not including Danny-boi himself), they will find it helpful to know that he puts hs garbage out on Monday, and puts his recycling out on Wednesday, and for $20 the garbage and recycling folks are more than happy to pick his up and separate it from the other peoples, and given that several are veterans, they are more than delighted to have been doing this for "quite a long time".

He is now a Vexatious Litigant in this particular court, but not in all venues, so as soon as he files anything in any other court in any other venue, all the person who Bernath is harassing needs to do it to inform the new court of the what the old court ruled, and the "Already Decided" aspect of his proper behavior is carried forward is it make the new court all the more eager to dismiss Bernaths new suit, in a new jurisdiction.

With a "Vexatious Litigant" having "further determined" it does rather rapidly throw a curse on anything he files with any court, for the rest of his life. One of the benefits, is that if/when Bernath files a suit, it can often be dismissed, before Bernath is actually able to serve a copy on the other side, in many cases as soon as a judge find out that Bernath has been barred in another court, they will dismiss his case (often the same day) and bar him from further filings.

It also makes it much easier to get attorney fees, or cover legal expenses, or time and aggravation, and because he is so void of reality, it makes it easier to get him civilly committed for insanity.

Because Judge Krier (in Ft. Myers) has done such a good job of "reaming Bernath a new one" there needs to be an examination on Danny-boi's access to firearms, and be needs to be declared a danger to himself and to others, and stripped of both his pilot's license, and be barred access to firearms by way of an involuntary civil commitment in excess of the automatic statutory 72 hour observation period.

Ideally, judge Krier should order a involuntary initial 48-72 hour observation period of Bernath, followed by 6 solid months of inpatient psychiatric care in a locked unit as this will automatically strip him of his right to arms, but the judge needs to actually say that he is psychotic and a lunatic, and those specific words need to be placed in the court finding, and the court needs to adjudge him to be a danger to himself, to the judiciary, and to the public at large. It is important that the Judge in Ft. Meyers places into the record the incident were Bernath assaulted a federal judge in the courthouse, and was convicted for it.

But, there is a complicating factor in all of this, because Bernath assaulted a federal judge, and he pled guilty to the assault as "Disordley Conduct", and while he was sentenced to an anger management class, he did violate 18 USC 111(a)(1), and it was a the commission of a felony, and he could have gotten 8 years in prison for it.

There is actually a fine line that needs to be noted. Bernath was convicted of Disorderly Conduct in a Federal Building under 25 CFR 11.441 which is a petty misdemeanor, but being the brain surgeon and cunning litigator that he is, the fact that each time he left Oregon the statute of limitation stopped polling, and resumed when he came back, but due to Bernath own twists on reality he moved to Florida while he was still inside the statute of limitation, and it can be proven that he actually is still subject to federal felony charges for the assault on a federal judge as he has not quite gotten a grip around the whole timing issue, and time as it were stopped each time he departed Oregon.

It should be noted that Bernath also confabulated an army of distractions to keep his residency in Florida a secret, and he had a proverbial cow when he sued the AL/VFW and they deposed him, busted him cold for lying under oath, and were able to get enough confirmable data out of him, so as to prove he was hiding out in Florida, and that the clock on the charges in Oregon was still stalking him, and continues to stalk him. There may at present be a Felony Warrant out on him in Oregon, for assault on a federal judge, and assault on federal property, along with a felony warrant ot of California, and a felony warrant out on him in Virgina, and most likely Flordia (which may or may not have dropped yet).

His establishing of the "Oregon Trail Trust" is also deeply flawed, and was improperly established and it null and void, and is nothing more than a shell entity, with no protection of Bernaths assets, real estate, or other assets held in the illicit trust.

Actually, if you very carefully step through the deed documents for the 1319 Kingswood Court residence you can see where Bernath had his daughter purchase the property through a trust, and then used the trust to sell him and his wife the property, and then be loaned his portion to his wife, but he screw the whole thing up and created gaping holes in the series of transactions, and violated both Florida and Oregon law in the process.

I would bring your attention to document 2015000019587 on file with the Lee Country Clerk of Court.

In terms of looking under stones, pay special attention to his daughter Nichole, as Bernath appears to be using her to launder his money, and has been doing it for quite a while.

As you may have guessed by now, I have turned Bernath and his antics into a "special project" and I am slowly financing and amassing a huge trove of documents not merely about Bernath, but also every single case where he has sued or been sued, and where he was an attorney in a case, all of his social security and veterans administration's claim, and pulling audio records and getting them converted to written and cross-indexed transcripts in PDF format and then submitting the "package of PDF documents" to several Internet Archives, and feeding them individually into Google in such a way they Bernath will not be able to trace the point of insertion, and then E-Mailing the documents to hundreds of his neighbors, the Americal Legion Posts nationally, and all of the VFW posts nationally. The initial goal will be to flood thousands of E-Mail addresses with documents, but to do it in a way that is least offensive, and to keep each document smaller.

I am also preparing a hardcopy version, that is printed on both side, and in neat tabbed, binders that can be sent to judges, clerks of court, or defense counsel as this will inflict the greatest damage to any future lawsuits that Bernath or his aliases will attempt. The touchy part is certain personal data can not be entered into the records of some courts, and others get touchy about documents that exceed 20-25 pages, so these will be broken up and spaced a few days apart in their mailing to the clerks, but full binders will be sent to the judges as an ex parte correspondence. Granted some judged may take the binder and add it to the file, but many will not, especially when the cover letter lists it as an ex parte matter for the judge to take under advisement.

With a clown like Bernath, the optimal way to shut him down is to ferret out all of the lawsuits, bar complaints, disbarments, arrest warrants, and so on. The, to provide these documents to anybody who would have even the slightest interest in Bernath, and to distribute them over an extremely wide area so that Bernath ends up spending the rest of his life chasing venues of this data, not ever actually shutting down more the 1%.

Then, it is a simple matter to have someone publish the documents, who has already confirmed their veracity, and taunt Bernath to sue them, and once he does, for them to spin around, counter-sue and lay down a trap for Bernath to step into. As Bernath like to get ripping drunk, and then go on a voice-mail and E-Mail rampage, it will just be a matter of patience until a bear-trap snaps him properly.

There really is nothing he can do to stop it, any of it, as none of it is defamatory if it can be proven to be true, and since Bernath has no level of self-control, he will rapidly earn sanctions and get hit with actual and treble damages. In fact, given his present legal situation, and the methods that he has used to file false claims for himself, his wife, and his clients, then every toy or property he has touched is tainted, and to put it quite frankly he is fucked, and fucked in a really big way.

As a business associate once told me "It ain't over until the obituary is published, and the body is buried"

In the Bernath case, it is easy to irrefutably prove that he has nothing but contempt for the law, and nothing but hatred of judges, even a greater hatred of law enforcement officers. He hates veterans, hates veteran organization, hates copy machines, fax machines, E-Mail, the WWW, and anything that can be used to out Danny-boi.

Once the packets are completed, they will be sent out from a Post Office in or near Ft. Meyers, so it will provide his with an abundance of frustration as to the origins of the packets that will be pumped out for a period of about 6 weeks. Then, each time he sues someone, the judge and the clerk will get copies, and just to ensure proper coverage of the topic, all judges in the courthouse will get their own personal copy, as will all the Prosecutors to ensure they all understands that there is a "turd floating in their punch bowl".

SDV means different things to different occupations, in some occupations it means "Swimmer Delivery Vehicle" but in this case we will refer it to the Bernath "Subversion Delay Vector" as it can be used to neutralize any court case Bernath might bring, and can be used to neutralize any and all threats he might make.

If there is someone what Bernath has harassed in any way, even slightly, no matter the topic or mechanism, it woudl be very helpful if you would hardcopy the Email form him, and submit it as correspondence in one of his active cases, a few dozen pages at a time. In the even he has left you voice mail, it woudl be helpful your you to copy these to a CD and get it into the hands of a court reporter so that it can be trasncripbed and the transcriptions added to the case files as examples of his antics. Also, when you do send these transcripts, please be sure to send the court a copy of the actual audio disc with the transcripts as his own works, in his own voice will hang him up in court in a big way.

Daniel Bernath lists his Wife as the owner, but lists himself as the titleholder. This is interesting, as the makes it really easy for the court to take the title away from him, and award it to someone else. Funny that "her signature" is actually HIS signature.

It looks like the end is near for Bernath, so much so that the Clerk is the refuse to accept anything with Bernath's name on it, unless it is first signed by a real attorney" of course Bernath is disobeying the judge in this, and he instantly went out and filed more legal papers that he was prohibited from doing.

He most especially disobedient Judge Krier, because she is a female judge.

Now it has gone to stage 3, whereby the clerk has been ordered not to accept a scrap of paper from Bernath, unless a real attorney signs off on it.

I have no doubt that Bernath with forge another name and signature on future filings, and he has a history of doing this in the past.

For those who have been following the Bernath "circling-the-drain" saga, he likes to file papers with the court, but not serve them on the attornies for his opposition, it is a form a fighting dirty that dishonest and disreputable attornies will play, and it is explicitly prohibited. To keep things fair, parties to an action must file copies of pretty much everything with the court,and then to all other parties, Bernath does not like to do this, and rather he like to try to blindside the other side with hearings they were never told about, regarding papers that Bernath put before the court, and which he was hoping the other side would not notice he filed.

From the following cases, it appears that Bernath has a history of filing lawsuits for the sole reason to harass and intimidate, but he keep losing cases, and losing, and losing, and losing and he never really gets punished appropriately, so he just keeps up the harassment. The only way to stop his psychotic behavior is to lock him is a locked psychiatric ward for six months, with mandatory treatment following his discharge.
